Acceptance of Terms

By accessing or using FamHaven, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you disagree with any part of the terms, you may not access the service.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of any material changes through the service or by other means. Your continued use of FamHaven after such modifications will constitute your acknowledgment and agreement to the modified terms.

Account Terms

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account and password. You agree to notify us immediately of any unauthorized access or use of your account.

Account Termination by Users

You may terminate your account at any time by following the account deletion process in the app settings or by contacting us at [email protected] with your deletion request. Upon termination, your profile and content may be removed from public view immediately, though certain information may be retained as outlined in our Data Retention section. Any pending transactions or ongoing obligations will remain your responsibility despite account termination.

Usernames and Trademarks

When creating and using usernames on our platform, you must ensure compliance with trademark and intellectual property rights.

Children's Privacy and Age Verification

FamHaven is strictly for users 18 years of age or older. By accessing or using our service, you represent and warrant that you are at least 18 years old. We do not knowingly collect personally identifiable information from minors. If we discover that a minor has provided us with personal information, we will immediately delete this information. As a parent-focused platform, we expect that all users are adults. We reserve the right to request proof of age at any time, and to terminate or restrict access to accounts where we reasonably believe the user is under 18 years of age. If you become aware that your child has created an account or provided personal information, please contact us immediately so we can take appropriate steps.

Content Policy

Our service allows you to post, link, store, share, and otherwise make available certain information, text, graphics, videos, or other material. You are responsible for the content you post, including its legality, reliability, and appropriateness.

By posting content on FamHaven, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods. You retain any and all rights to any content you submit, post, or display, and you are responsible for protecting those rights.

You must only upload images or content that you own or have the right to use. This includes photographs, graphics, videos, logos, and other visual media.

Content that includes third-party trademarks, logos, or branded materials may be removed if the brand owner objects to its use. Users must not imply endorsement or affiliation with brands through their uploaded content.

We follow the procedures outlined in the Digital Millennium Copyright Act (DMCA) for copyright infringement claims. If you believe your copyrighted work has been used without permission, please contact us with details at [email protected].

Content License

By posting content on FamHaven, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods. This license authorizes us to make your content available to the rest of the world and to let others do the same.

User Content Rights and License

By submitting content to our Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your content in connection with the Service and our business operations.

Even after you delete your account, certain content may persist in backup copies or where required by law, or where others have copied or stored your content in compliance with these Terms.

You retain ownership of your content, but you acknowledge that you have the necessary licenses and rights to grant us the license described above.

AI-Generated Content

You must clearly identify content created using AI or automated tools if such content is shared on our platform. You remain responsible for all content you post, including AI-generated content, which must comply with all provisions of these Terms. We reserve the right to remove AI-generated content that violates our content policies, infringes on intellectual property rights, or could reasonably mislead other users regarding its origin or authenticity. We may use AI tools to assist with content moderation, translation, or other service operations.

API Usage and Data Scraping

You agree not to use or develop any automated system, including but not limited to 'robots', 'spiders', or 'offline readers' to access the Service in a manner that sends more request messages to FamHaven servers than a human can reasonably produce in the same period using a conventional web browser. Scraping, harvesting, extracting, or collecting content from the Service without our express permission is strictly prohibited. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service through the interfaces we provide.

Intellectual Property Rights

The service and its original content, features, and functionality are and will remain the exclusive property of FamHaven and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe your copyright has been infringed on our platform, please submit a DMCA copyright infringement notice containing:

Logging Practices

We prioritize your privacy in our logging practices. We do not store any personal user data such as user IDs or email addresses in our system logs.

Our application logs only contain anonymized information like system performance metrics, error reports, and usage statistics to help improve app functionality and troubleshoot technical issues.

You can opt out of analytics collection during onboarding or at any time in the settings menu. This choice will not affect your experience using the app.

All logging is performed solely for legitimate technical purposes: troubleshooting errors, monitoring system performance, enhancing security, and improving user experience.

Data Retention

Following account deletion, we may retain certain information for a limited period as required by law or for legitimate business purposes. Personal data associated with your account will be deleted or anonymized within 30 days of account deletion, except where retention is necessary for legal compliance, fraud prevention, or dispute resolution.

International Operations

We store and process your data in the United States and other countries. By using the Service, you consent to the transfer of your data outside of your country of residence.

We comply with international data protection laws including GDPR, LGPD, and CCPA. Users in these jurisdictions have specific rights as detailed in our Privacy Policy.

You agree to comply with all applicable export and re-export control laws and regulations in your use of the Service.

Platform Security

You are responsible for maintaining the security of your account credentials and for any activity that occurs under your account. We implement reasonable security measures but cannot guarantee absolute security.

API access is subject to rate limiting and monitoring. Excessive or abusive usage may result in temporary or permanent suspension of access.

We may access, preserve, and disclose your information if we believe in good faith that doing so is necessary to: (i) protect the safety of a person; (ii) address potential violations of our Terms or policies; (iii) prevent fraud or abuse; or (iv) protect our or others' rights, property, or safety. Advertising

FamHaven may be supported by advertising. By using our service, you acknowledge and agree that we may display advertisements within the application. These advertisements may be contextual or personalized based on information we collect or receive about you, in accordance with our Privacy Policy.

We may work with third-party advertising partners who may collect information about you to provide advertisements. These partners may use cookies, web beacons, and similar technologies to collect information about your use of our service and other websites and applications.

By continuing to use FamHaven, you accept the advertising that appears within the service. Your device or platform settings may offer limited controls over certain types of advertising, but the service itself requires acceptance of advertisements as part of its usage terms.

You agree not to interfere with, block, or otherwise tamper with advertisements displayed on the service. Advertisements are part of the service provided to you and interfering with their display may constitute a violation of these Terms.

Content Moderation

We strive to review reports of inappropriate or violating content within 24-48 hours after submission. However, moderation timeframes may vary based on volume and available staff. High-priority issues involving safety risks, illegal content, or harassment will be prioritized. We reserve the right to temporarily disable access to contested content during review.

Uploaded images and content will be analyzed using automated systems, including AI technology, for compliance with our community guidelines. Content that violates our policies may be removed with notification.

Reporting Criminal Activity

We take reports of illegal activity seriously. If you encounter content that you believe constitutes criminal activity, please report it immediately to [email protected]. We may be legally obligated to report certain types of illegal activity and evidence to relevant law enforcement authorities. We reserve the right to cooperate with legal authorities in the investigation of any suspected criminal activity.

Modifications to Terms

We will provide notice of any material changes to these Terms at least 14 days prior to their implementation through the service or via email to the address associated with your account. Your continued use of the service after this notice period constitutes your acceptance of the modified terms.

Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the service, temporarily or permanently, with or without notice. We may introduce new features, change existing features, or remove features from the service at our discretion. Where practical, we will provide notice of material changes to the service functionality. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service or any features.

Virtual Items and In-App Purchases

We may offer virtual items, features, or services for purchase within the application. All purchases are final and non-refundable except as required by applicable law. Virtual items and currency have no monetary value and cannot be exchanged for real money, goods, or services outside the application. We reserve the right to modify, manage, control, or eliminate virtual items without notice or liability. Any unauthorized transfer or sale of virtual items violates these Terms and may result in account termination.

Commercial Terms

Any commercial use of the Service must be explicitly authorized by FamHaven. Business accounts may be subject to additional terms and fees.

Promotional content must be clearly identified as such and comply with all applicable advertising laws and regulations.

We may participate in affiliate programs and receive compensation for referrals to third-party products or services.

Technical Operations

While we strive for 99.9% service availability, we do not guarantee uninterrupted access to the Service. Scheduled maintenance windows will be announced in advance when possible.

We regularly backup data but are not responsible for your own backup requirements. You are encouraged to maintain your own copies of important content.

Third-party integrations are provided 'as is' and may be modified or discontinued at any time. We are not responsible for the availability or functionality of third-party services.

California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) provide you with specific rights regarding your personal information.

Limitation of Liability

To the maximum extent permitted by law, FamHaven, its directors, employees, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the past twelve months or $100, whichever is greater.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of war, acts of God, earthquake, flood, embargo, riot, sabotage, labor shortage or dispute, governmental act, power failure, or Internet or telecommunications disruption.

Disclaimer

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms and Conditions. Upon termination, your right to use the service will immediately cease.

Indemnification

You agree to defend, indemnify, and hold harmless FamHaven and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, including but not limited to attorney's fees, resulting from or arising out of your use and access of the service, or your violation of these Terms and Conditions.

Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Governing Jurisdiction

These Terms and your use of the service shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal proceedings shall be held exclusively in the state or federal courts located in New York, United States, and you consent to the personal jurisdiction of these courts.

Dispute Resolution and Arbitration

Any dispute arising from or relating to these Terms shall be resolved through binding arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted in English, in the State of New York, United States. You agree to waive any right to participate in class actions or collective proceedings.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdiction.

Nothing in these Terms prevents either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property or unauthorized access to the Service.

Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration, rather than in court. The arbitration will be conducted by a neutral arbitrator and governed by the rules of the American Arbitration Association (AAA). The arbitration shall be conducted in English, in the State of New York, United States. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

You agree to resolve disputes with FamHaven on an individual basis, and hereby waive any right to participate in a class action lawsuit or class-wide arbitration.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Force Majeure

FamHaven shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, pandemic, war, terrorism, riots, civil unrest, government action, internet disturbances, or service provider failures.

Additional Regulatory Compliance

For users in Brazil, we comply with the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados, or LGPD). Your rights under the LGPD are similar to those provided under the GDPR, including the right to access, correct, and delete your personal data.

When downloading the application through an app distribution platform such as the Apple App Store or Google Play Store, you acknowledge that your use of the application may also be subject to the terms of use governing that distribution platform. Nothing in these Terms is intended to conflict with or override the terms and policies of these distribution platforms that are applicable to you.
